Brazil model comparison

PEO or EOR in Brazil?

In Brazil the US style PEO co-employment model does not map cleanly onto local employment law. A company without a Brazilian entity generally needs an Employer of Record, where a local employing structure is the legal employer of record for the worker. What providers market as a Brazil PEO is usually either an EOR, or payroll and HR administration for a company that already has its own entity. Decide by asking whether you have a Brazilian entity, because that single fact selects the route.

Employer of Record

Fits when
You have no Brazilian entity and need to employ people now.
Do not use when
You already operate a Brazilian entity and only need payroll and HR support.

A local employing structure is the legal employer, while you direct the work.
Cost shape
Landed employment cost plus a fixed or percentage service fee.

PEO style administration

Fits when
You already have a Brazilian entity and want payroll, benefits and HR administration handled locally.
Do not use when
You have no entity, since administration alone cannot make you a lawful employer in Brazil.

Questions buyers ask

Frequently asked questions

Is there a PEO in Brazil?

Not in the US co-employment sense. Brazilian law recognises a single legal employer, so services marketed as a Brazil PEO are normally either an Employer of Record or payroll and HR administration for a company that already has a local entity.

What is the difference between a PEO and an EOR in Brazil?

An EOR becomes the legal employer of your worker through a local employing structure, so you can hire without an entity. PEO style administration supports a company that is already the employer through its own Brazilian entity.

Which do I need if I have no entity in Brazil?

An Employer of Record. Without a Brazilian entity you cannot be the registered employer, so the employment relationship has to sit with a local employing structure.
